What happens if a physician does not respond to a request for a copy of medical records?
Under HIPAA, you are guaranteed access to your medical records. If a physician fails to provide copies of your medical records upon your request within the legal time limit or at all, the Medical Board may take action. Their action can range from following up to ensure that the doctor provides the records you have requested, all the way up to a citation, fine, or disciplinary action on the doctor’s medical license. Be sure to make your request in writing and have backup documentation, including copies to prove that you requested the records.
